Privacy Policy

In keeping with my obligations as a legal professional, I am committed to maintaining the highest standards of privacy with respect to all information that is provided to me. My client relationships are built on trust, and I am committed to maintaining that trust. This privacy policy outlines my practices relating to the collection, use and disclosure of personal information provided to me. While this privacy policy has been developed to comply with PIPEDA, I wish to stress that, as a lawyer, my obligations and duties to my clients to maintain confidentiality in respect of all other matters is in no way diminished or reduced.
Personal information refers to the personal characteristics of identifiable individuals. Examples of personal information include an individual’s name, gender, income, age, home address or phone number. Personal information is to be contrasted with business information, such as an individual’s business address and telephone number. Business information is not covered by privacy legislation.
The following is a description of how I protect personal information and the limited exceptions to this policy.
I collect personal information for the following limited purposes:
- To enable me to serve my clients
- To enable me to contact and bill my clients
The collection of personal information is limited to only that which is necessary for these purposes. I do not use personal information to sell to direct marketing agencies or provide it to anyone outside my firm.
I do not collect personal information without consent. By initiating contact or providing personal information, you are deemed to consent to the reasonable collection, use, and disclosure of your personal information for these purposes.
A number of measures are taken to ensure the security of my clients’ personal information. These include the following:
- I am responsible for the care and control of personal information.
- My staff are trained to collect and use personal information only as necessary to perform their duties and in accordance with my privacy policy.
- My firm restricts the collection of personal information to that required for the purposes noted above.
- Once personal information is no longer required for the purposes noted above and under the rules of the Law Society of Ontario, it is destroyed in due course.
- Paper information is under supervision.
- I destroy paper information by shredding, electronic information by deletion, and when hardware is discarded, I ensure that the hard drive is destroyed.
Notwithstanding my commitment to protecting my clients’ personal information, there are some limited instances where I am obliged to disclose information without consent. These are the following:
- Where the information is known to the public.
- Where required by law or by court order.
- Where I believe, upon reasonable grounds, that there is an imminent risk to an identifiable person or group of death or serious bodily harm.
- Where it is alleged that an associate or employee of the firm is guilty of a criminal offence.
In such circumstances, I will not disclose more information than is required.
As noted above, I am responsible for the care and control of all personal information at my firm. I welcome any requests to verify the accuracy of the personal information I have, and the identity of any parties to whom I may have had reason to disclose the information.
If any client has a complaint regarding my privacy practices, I encourage them to contact me directly. I will investigate all complaints and provide a timely written response. If a complaint is found to be valid, I will take appropriate steps to resolve the matter to the client’s satisfaction.
